Fynso Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, web and mobile applications, APIs, dashboards, and other related services (collectively, the "Services") operated by Fynso AI LLC ("Fynso," "we," "us," or "our").
By accessing or using the Services, you agree to these Terms and our Privacy Policy, which together form a legally binding agreement.
If you do not agree, do not use the Services.
1. Eligibility and Business Use
- You must be at least 18 years old and have the legal authority to bind your business or organization.
- The Services are designed for business and professional use only, not for personal or consumer purposes.
- By registering, you represent that all provided information is accurate, complete, and current.
2. Our Services
Fynso is a revenue intelligence platform for businesses. The Services analyze the business, schedule, booking, billing, and financial data you choose to connect to Fynso and deliver insights, recommendations, alerts, communications, and related functionality designed to help you understand and grow the revenue and operational health of your business.
The specific features, integrations, workflows, and capabilities available within the Services are described on the Fynso website and inside the product itself, and may be added, modified, deprecated, or removed at any time and without notice. Certain features may be available only on specific subscription plans, may require you to connect particular third-party systems, or may be limited by the availability of those systems.
Fynso may also offer beta, preview, or experimental features from time to time. These features are provided "as is," may change or be discontinued without notice, and are not guaranteed to continue as part of the Services.
Material changes to the Services that adversely affect your paid use of the Services will be communicated to you by email or in-product notification.
Important Disclaimers:
- Fynso is not a lender, financial institution, or fiduciary. Fynso does not provide legal, tax, accounting, or investment advice.
- Fynso does not guarantee specific revenue, financial, operational, or business outcomes. Insights, recommendations, and communications generated by the Services are produced by software (including artificial intelligence and machine learning models) and may be incomplete, inaccurate, or contain errors.
- You are solely responsible for reviewing any output, communication, or recommendation produced by the Services before relying on or acting on it. You should consult qualified professionals before making financial, tax, legal, or other material decisions.
3. Account Registration and Security
- You must create an account to access certain Services.
- You are responsible for maintaining the confidentiality of your credentials and all activities under your account.
- You agree to immediately notify Fynso of any unauthorized use or breach.
- Fynso is not responsible for losses caused by unauthorized access resulting from your actions or inaction.
4. Data Use and Ownership
- You retain full ownership of your business and financial data.
- By using the Services, you grant Fynso a limited, non-exclusive, revocable license to process your data solely for delivering the Services to you.
- Fynso integrations are read-only and cannot write to, modify, or move data in your connected systems.
- We do not sell your data and do not use your data to train AI models for other customers.
- Fynso may use aggregated and anonymized operational data to improve the platform and its insights. Such data contains no personally or business-identifying information.

5. Security and Data Protection
Fynso is built on SOC 2 compliant infrastructure and implements the following safeguards to protect your business and financial data:
- Encryption:TLS 1.2+ for all data in transit, AES-256-GCM encryption for sensitive credentials and integration tokens, and database encryption at rest via our managed infrastructure.
- Access Controls:Read-only integrations, row-level security policies, and encrypted API keys and tokens for every connection.
- Compliance:Actively partnering with Drata to formalize SOC 2 Type II and HIPAA certifications.

6. Acceptable Use
You agree to use Fynso responsibly. You will not:
- Engage in illegal, fraudulent, or deceptive activities.
- Copy, reverse engineer, or modify any part of the Services.
- Attempt unauthorized access to data or systems.
- Use automated scripts to extract data or overwhelm servers.
- Use the platform to misrepresent financial or business information.
Violation of this section may result in immediate termination and potential legal action.
7. Subscriptions, Fees, and Payment
- Some Services require paid subscriptions or usage-based fees.
- Pricing, billing intervals, and cancellation terms are disclosed prior to purchase.
- All payments are due in U.S. dollars and are non-refundable except as required by law.
- Fynso may update pricing with notice prior to renewal.
8. Intellectual Property
- All content, software, algorithms, visual design, and branding are owned by Fynso AI LLC or its licensors.
- You receive a limited, non-exclusive, non-transferable, revocable license to use the Services for internal business purposes only.
- You may not copy, distribute, resell, or create derivative works without our written consent.
- "Fynso," the Fynso logo, and associated marks are trademarks of Fynso AI LLC.
9. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL CONTENT, INSIGHTS, RECOMMENDATIONS, COMMUNICATIONS, AND OTHER OUTPUT PROVIDED THROUGH THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. FYNSO SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Without limiting the foregoing, Fynso does not warrant that:
- The Services will be uninterrupted, timely, error-free, or secure.
- Any insights, recommendations, projections, drafts, or other output will be accurate, complete, or will produce any specific outcome for your business.
- Third-party integrations, data sources, APIs, or services (including but not limited to Plaid, QuickBooks, Stripe, Square, and any other integration available from time to time) will be available, uninterrupted, accurate, or free of errors or delays.
Regarding AI-Generated Output:
Portions of the Services use artificial intelligence and machine learning models to analyze data and produce insights, drafts, summaries, and recommendations. These outputs are generated automatically, may be incomplete or incorrect, and may not reflect the most current state of your business or its connected systems. You are solely responsible for reviewing, verifying, editing, approving, and deciding whether to act on any AI-generated output before using it or sending any communication derived from it. Fynso is not liable for actions taken, omissions, or communications sent based on AI-generated output.
Third-party services integrated with Fynso are operated independently by their respective providers under their own terms and privacy policies. Fynso is not responsible for the availability, accuracy, reliability, performance, security, or actions of any third-party service.
You acknowledge and agree that you are solely responsible for all business, financial, operational, and communication decisions you make based on the Services.
10. Limitation of Liability
To the maximum extent permitted by law:
- Fynso and its affiliates are not liable for indirect, incidental, special, or consequential damages, including loss of profits or data.
- Our total liability under these Terms shall not exceed (a) the amount paid to Fynso in the previous six months, or (b) $500 USD, whichever is greater.
- These limitations apply even if we have been advised of the possibility of such damages.
11. Indemnification
You agree to indemnify, defend, and hold harmless Fynso AI LLC, its affiliates, officers, employees, and agents from all claims, damages, or losses arising from:
- Your use or misuse of the Services.
- Your violation of these Terms.
- Your violation of any applicable law, regulation, or third-party right.
12. Suspension or Termination
Fynso may suspend or terminate your access if:
- You breach these Terms, abuse the platform, or pose a security risk.
- Required by law, regulation, or legal process.
- You request account closure.
Upon termination, we may retain minimal records for compliance but will deactivate your access and delete data per our retention policy.
13. Governing Law and Dispute Resolution
- These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law principles.
- Any disputes will be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) rules.
- Class actions, jury trials, and consolidated proceedings are waived.
- Each party bears its own legal costs unless otherwise required by law.
14. International Use
If you access Fynso from outside the U.S., you consent to the transfer and processing of your data in the United States under applicable safeguards.
15. Modifications
We may revise these Terms from time to time.
If changes are material, we will notify you via email or in-app notice. Continued use after changes become effective constitutes acceptance.
16. Force Majeure
Fynso will not be liable or responsible, nor be deemed to have defaulted under or breached these Terms, for any failure or delay in performance caused by acts or circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, fire, flood, earthquake, pandemic, war, terrorism, civil unrest, government action, labor disputes, internet or telecommunications failures, power outages, cyberattacks, or the failure, interruption, or unavailability of any third-party service, integration, data source, hosting provider, or infrastructure provider used to deliver the Services.
17. Assignment
You may not assign, transfer, or delegate these Terms or any rights or obligations hereunder, in whole or in part, without Fynso's prior written consent. Any attempted assignment in violation of this section will be null and void. Fynso may freely assign or transfer these Terms, in whole or in part, without restriction, including (without limitation) in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets. These Terms will bind and inure to the benefit of the parties and their permitted successors and assigns.
18. Survival
Any provisions of these Terms that by their nature are intended to survive termination or expiration will continue in full force and effect after termination or expiration, including without limitation: Data Use and Ownership, Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law and Dispute Resolution, and any accrued payment obligations.
19. Severability and Waiver
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. All remaining provisions will remain in full force and effect.
Fynso's failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. No waiver by Fynso will be effective unless made in writing and signed by an authorized representative.
20. Entire Agreement
These Terms, together with the Privacy Policy and any other agreements referenced herein, constitute the complete and exclusive understanding between you and Fynso with respect to the Services and supersede all prior or contemporaneous agreements, communications, and understandings, whether written or oral.
